Welcome to LumiNest. These Terms of Service ("Terms") govern your access to and use of luminesthq.com (the "Site") and any purchase you make from LumiNest ("LumiNest," "we," "us," or "our"). By visiting the Site, creating an account, or placing an order, you agree to be bound by these Terms, our Return & Refund Policy, and our Shipping Policy, which are part of these Terms. If you do not agree, do not use the Site or place an order.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. If you are under that age, you may use the Site only with the involvement of a parent or legal guardian. By placing an order, you confirm that the information you provide is accurate and that you are authorized to use the payment method you submit.
2. Your Account
If you create an account, you are responsible for keeping your login information confidential and for all activity under your account. Notify us immediately at luminesthq@gmail.com if you believe your account has been used without your permission. We may suspend or close accounts at our discretion.
3. Products and Descriptions
We make every effort to display products, colors, and projection effects accurately. However, photos and videos are for illustration purposes, and actual appearance may vary depending on room size, wall surface, lighting, distance, and the screen you use to view the Site. We do not guarantee that product descriptions, images, or other content are complete, current, or error-free. All products are subject to availability, and we may limit quantities or discontinue any product at any time without notice.
4. Pricing and Errors
All prices are listed in U.S. dollars and may change at any time without notice. If a product is listed at an incorrect price or with incorrect information due to a typographical, technical, or supplier error, we reserve the right to refuse or cancel any order placed for that product, even after the order has been confirmed or your payment has been charged. If we cancel an order for this reason, we will notify you and refund any amount charged for the cancelled item.
5. Orders and Acceptance
Your order is an offer to purchase. An order confirmation email does not mean we have accepted your order. We reserve the right to refuse, limit, or cancel any order for any reason, including suspected fraud, unauthorized or high-risk transactions, reseller activity, errors in product or pricing information, or inventory limitations. We may require additional verification before processing an order.
6. Payment
Payment is due in full at the time of purchase. By submitting payment, you authorize us and our payment processors to charge the full order amount, including applicable taxes and shipping fees. You agree not to use a payment method you are not authorized to use.
7. All Sales Are Final
All sales are final. LumiNest does not offer refunds, returns, exchanges, or cancellations. The only exception is a verified damaged, defective, or incorrect item reported within 48 hours of delivery, which is eligible for store credit only, as described in our Return & Refund Policy.
8. Shipping and Risk of Loss
Processing and shipping times are estimates and are not guaranteed. Title and risk of loss for all products pass to you when the order is handed to the carrier. LumiNest is not responsible for delays, lost packages, or packages marked as delivered. Full details are in our Shipping Policy.
9. Chargebacks and Payment Disputes
You agree to contact LumiNest at luminesthq@gmail.com and give us a reasonable opportunity to resolve any issue before filing a chargeback or payment dispute. We will contest disputes that violate these Terms using order records, carrier tracking and delivery confirmation, your acceptance of these Terms, and all communications. We may refuse future orders from, and close the accounts of, customers who file unwarranted chargebacks.
10. Product Use and Safety
You agree to use all products according to their instructions and for their intended purpose. Do not look directly into any light source or laser, do not expose products to water or extreme heat, and use only compatible power sources and cables. Keep products and small parts away from young children unless supervised. LumiNest is not responsible for injury, damage, or loss resulting from misuse, modification, improper installation, or failure to follow instructions.
11. Intellectual Property
All content on the Site, including text, graphics, logos, product images, videos, and design, is the property of LumiNest or its content suppliers and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, modify, or use any content from the Site for commercial purposes without our prior written permission.
12. Prohibited Uses
You agree not to: use the Site for any unlawful purpose; submit false or misleading information; place fraudulent orders; resell products purchased from the Site without our permission; interfere with the security or operation of the Site; use bots, scrapers, or automated tools to access the Site; upload viruses or harmful code; or harass, abuse, or harm others. We may suspend or terminate your access to the Site for any violation of these Terms.
13. Reviews, Comments, and Submissions
If you submit reviews, photos, videos, comments, or other content to us or on the Site, you grant LumiNest a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, edit, publish, and display that content in any media, including marketing, without compensation to you. You confirm that your content is your own, is truthful, and does not violate any law or the rights of others. We may remove any content at our discretion.
14. Third-Party Links and Services
The Site may contain links to or integrations with third-party websites and services, including payment processors and shipping carriers. We are not responsible for the content, policies, or practices of any third party, and your use of them is at your own risk.
15. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. LumiNest does not warrant that the Site will be uninterrupted, secure, or error-free, or that products will meet your expectations.
16. Limitation of Liability
To the fullest extent permitted by law, LumiNest and its owners, employees, suppliers, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Site or any product. Our total liability for any claim related to a purchase is limited to the amount you paid for the product giving rise to the claim.
17. Indemnification
You agree to defend, indemnify, and hold harmless LumiNest and its owners, employees, suppliers, and partners from any claims, losses, damages, liabilities, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of any product, or your violation of any law or the rights of a third party.
18. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us at luminesthq@gmail.com and attempt to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally will be brought only in the state or federal courts located in New York, New York, and you consent to the jurisdiction of those courts. To the extent permitted by law, you agree that any claim will be brought only in your individual capacity and not as part of a class or representative action.

Your use of the Site and any personal information you provide are also governed by our Privacy Policy.
20. Changes to These Terms
We may update these Terms at any time by posting the revised version on the Site. Changes take effect when posted. The version in effect at the time of your purchase applies to that order. Your continued use of the Site after changes are posted means you accept the updated Terms.
21. Severability and Entire Agreement
If any part of these Terms is found to be invalid or unenforceable, the remaining parts will remain in full effect. These Terms, together with our Return & Refund Policy, Shipping Policy, and Privacy Policy, are the entire agreement between you and LumiNest regarding the Site and your purchases. Our failure to enforce any right or provision does not waive that right or provision.
